ALS Hospice Documentation: Avoiding Medicare Audit Pitfalls Through Better Clinical Records

ALS gives a hospice team one of the clearest terminal trajectories in medicine — and one of the most unforgiving documentation standards. Medicare’s improper payment rate for hospice claims has hovered around 12%, and the single most common reason for denial remains the same: documentation that does not clearly support a prognosis of six months or less. For patients with amyotrophic lateral sclerosis, auditors look hardest at one thing — respiratory decline — because breathing capacity is the primary driver of prognosis in end-stage disease.

Also known as Lou Gehrig’s disease, ALS attacks the nerve cells that control voluntary muscle movement, producing progressive weakness and, eventually, respiratory failure. These patients clearly benefit from hospice in their final months. The challenge is never whether they belong in hospice — it’s whether the chart proves it. Let’s walk through the three LCD pathways to ALS eligibility and the specific, measurable language that makes a note far more likely to defend.

Why Auditors Scrutinize ALS Claims

Hospice claims have been a recurring target of Supplemental Medical Review Contractor (SMRC) activity, and ALS sits in the crosshairs for a specific reason. Unlike conditions where decline is gradual and diffuse, ALS often progresses rapidly along a measurable axis — respiratory function. That measurability cuts both ways. It gives you objective data to document, and it gives an auditor objective data to check. When that data is missing, the claim is exposed.

The Three Pathways to ALS Terminal Status

Medicare’s Local Coverage Determination guidelines establish three distinct pathways to ALS hospice eligibility. Remember that these are guidelines requiring clinical judgment, not pass/fail thresholds — but the closer your documentation tracks them, the stronger your defense.

Pathway 1: Critically Impaired Breathing

This pathway looks for critically impaired respiratory function, typically reflected by:

  • Vital capacity (VC) less than 30% of normal
  • Significant dyspnea (shortness of breath) at rest
  • Requiring supplemental oxygen at rest
  • The patient declines artificial ventilation

Pathway 2: Rapid Progression Plus Nutritional Decline

This pathway pairs rapid disease progression with critical nutritional impairment:

  • Progression from walking independently to wheelchair- or bed-bound
  • Speech changes from normal to barely intelligible
  • Diet changes from a normal diet to pureed foods only
  • Loss of independence in activities of daily living
  • Oral intake insufficient to sustain life, with continued weight loss and dehydration in the absence of artificial feeding

Pathway 3: Rapid Progression Plus Life-Threatening Complications

This pathway pairs rapid progression with serious, life-threatening complications:

  • Recurrent aspiration pneumonia from swallowing dysfunction
  • Upper urinary tract infection (pyelonephritis)
  • Sepsis
  • Recurrent fevers after antibiotic therapy
  • Multiple stage 3–4 pressure ulcers

Common Documentation Pitfalls — and How to Fix Them

Missing objective measurements

The problem: A note reads “patient appears short of breath,” with no measurable data behind it. The fix: Anchor the observation in numbers — respiratory rate (normal is 12–16 breaths per minute), oxygen saturation, and vital capacity percentage where available.

Respiratory rate 24 breaths per minute at rest, oxygen saturation 88% on room air, requiring 2L oxygen via nasal cannula.

Vague functional assessments

The problem: “Patient is declining” with nothing to measure against. The fix: Use a standardized tool like the Palliative Performance Scale (PPS) and show movement along it.

PPS declined from 60% to 40% over the past three months. Patient now requires assistance with all activities of daily living; was previously independent with bathing and dressing.

Inadequate weight-loss documentation

The problem: “Patient losing weight,” with no percentage or timeframe. The fix: Calculate and document the percentage loss over a defined period.

Patient lost 15 pounds over four months — a 12% weight loss from a baseline of 125 lbs to a current weight of 110 lbs.

Weak physician narratives

The problem: A generic certification statement signed by the physician with no patient-specific clinical content. The fix: The narrative should cite specific clinical findings, objective measurements, and a clear explanation of how this patient meets the LCD criteria for a terminal prognosis. A narrative in the physician’s own clinical voice is one of the strongest pieces of an ALS chart.

Respiratory Assessment Is the Heart of an ALS Chart

In end-stage ALS, two functions drive prognosis: the ability to breathe and, to a lesser degree, the ability to swallow. That makes respiratory documentation the single most important section of the note. Capture the full spectrum of what you see:

  • Dyspnea at rest — shortness of breath without exertion
  • Orthopnea — difficulty breathing while lying flat
  • Accessory muscle use — visible recruitment of neck and intercostal muscles
  • Weakened cough — inability to clear secretions effectively
  • Sleep-related breathing disturbance — frequent awakening due to air hunger

Patient exhibits severe dyspnea at rest with a respiratory rate of 26 breaths per minute. Unable to lie flat due to orthopnea; sleeps propped on three pillows. Visible accessory muscle use in the neck and intercostal spaces. Cough weak and ineffective for clearing secretions. Frequent nighttime awakening from breathing difficulty, leading to daytime somnolence.

Best Practices Across the Certification Period

At admission

  • Establish clear baseline measurements for every functional domain
  • Document respiratory function tests when available
  • Record exact weight and calculate BMI
  • Assess and document a PPS score
  • Note any artificial-feeding and ventilation decisions

During routine visits

  • Compare current status against baseline
  • Document specific changes in respiratory function
  • Record weight change as a percentage
  • Update functional status using a standardized scale
  • Note any new complications or infections

At recertification

  • Summarize the decline across the certification period
  • Include objective measurements supporting continued eligibility
  • Address any LCD criteria that were thin in the prior period
  • Capture the physician’s specific clinical rationale for continued terminal prognosis

Catching Gaps While the Note Is Still Open

The trouble with traditional chart review is timing. It happens after the note is closed — sometimes months later, during an appeal — when the visit is no longer fresh and the record can’t be expanded. The better moment to strengthen an ALS note is while the nurse is still writing it.
